Autonomia existencial

Resumo

Num ordenamento que tem como pilares fundamentais o pluralismo e a dignidade da pessoa humana, é plenamente possível, por meio de uma escolha autônoma e responsável, que o titular do direito tome decisões autorreferentes, que abranjam os aspectos existenciais da sua vida. Tais concepções tornaram-se admissíveis a partir do momento em que o legislador constituinte estabeleceu um catálogo de direitos fundamentais, no qual a pessoa poderá escolher, segundo o projeto de vida que construiu para si e os valores individuais, a forma de viver a própria vida. Nesse sentido, ao tutelar a liberdade, a privacidade e a dignidade, o constituinte deixou a cada um a possibilidade da construção da vida privada em questões afetas à intimidade. Decisões existenciais, portanto, só são legítimas quando tomadas pelo próprio titular, desde que ele esteja informado e consciente do seu ato, bem como das suas consequências. Por isso, as projeções da subjetividade nos espaços compartilhados de intersubjetividade devem ser definidas pela pessoa.

Abstract

In an order whose fundamental pillars are pluralism and the dignity of the human person, it is fully possible, through an autonomous and responsible choice, for the right holder to make selfreferential decisions that cover the existential aspects of his life. Such conceptions have become admissible once the constituent legislator has established a catalog of fundamental rights, in which the person can choose, according to the project of life he has built for himself and the individual values, the way of living his own life . In this sense, by protecting freedom, privacy and dignity, the constituent left to each one the possibility of constructing private life in questions related to intimacy. Existential decisions, therefore, are only legitimate when taken by the owner himself, provided he is informed and aware of his act, as well as its consequences. Therefore, the projections of subjectivity in the shared spaces of intersubjectivity must be defined by yourself.
