The transition from legal freedom to private autonomy in the doctor-patient relationship and its effects on supplementary health

Abstract

This research aims to analyze the links between the principle of private autonomy within the scope of Supplementary Health. Among several related aspects, it focuses on the possibility of restricting an equally effective and less costly medical treatment when this is not the patient's desire. Considering that the problem of the article lies in the question about the existence of mandatory treatment costs by the Health Plan operator if it is not based on medical protocols and, if so, what are the premises to be observed, it reflects on the consequences of adopting the idea of ​​private autonomy in legal relations by making the counterpoint between the patient's choice and the duty of coverage of healthcare operators. The work has a delimited object which, in turn, is investigated by the hypothetical deductive method based on bibliographic and jurisprudential collection.
