Liability in Brazilian Family Law: a comparative law analysis

Abstract

The article deals with the issue of liability in family law. The work is based on case studies and has a comparative perspective. The first part addresses, initially, the particularities of the concept of family in Brazil, which includes common-law marriage and social-affective parenthood. Then, it exposes the conditions of legal liability and examines its incidence in family relationships. The second part exposes cases in which the STJ has recognized that damages are due between spouses and cohabitants for omission regarding the biological paternity of a child born in marriage or common-law marriage. Cases involving parents and children, in the so-called affective abandonment and reverse abandonment are examined.
