Conflicts of interest between civil law and public health measures in the Covid-19 pandemic

Abstract

This article aims to analyze the measures adopted during the covid-19 pandemic in light of Civil Law. To do so, a literature review is carried out on the subject, presenting the main legal norms that regulated the pandemic, as well as doctrinal and jurisprudential discussions about the restrictions on fundamental rights. The article also reflects on the civil liability of governments, companies, and individuals during the pandemic. It is concluded that, although the measures adopted were necessary to preserve public health, it is important that they be evaluated in light of the fundamental principles of Civil Law, ensuring the protection of fundamental rights and fair compensation in case of harm.
