The ecological function of the principle of good faith

Abstract

This study aims to present the concept of the “ecological function of good faith” and the broader notion of the “civil dimension of sustainability,” analyzing how ecological principles should guide traditional civil relationships, in the same manner as the incorporation of human dignity—through the social function and good faith—during the constitutionalization of private law. To achieve this objective, the study employed bibliographical research, deductive reasoning, and the theoretical-legal method. In conclusion, the concepts were reaffirmed, and several examples were provided to illustrate how this function can be effectively applied as a new ancillary duty arising from the principle of good faith.
