The question of authorship and ownership of works created by generative ai image systems and their potential in brazilian law

Abstract

Artificial intelligence is an attempt to replicate the human capacity to create, being, in some cases, capable of producing objectively new works, due to the technological advance. In this context, with the emergence of artificial intelligences that generate visual works, there is a legislative vacuum in Brazil regarding the protection of copyright, with Law n.º 9,610/95 not being able to protect such rights, given the absence of subjective originality, the fact that it is not a spirit creation and the lack of legal personality for machines. In this way, there are several theories that try to solve the problem, with a great doctrinal discussion. It was concluded that the most appropriate theory is the one that advocates that the works are in the public domain, although the practicality of creating a legal personality for machines is recognized. It was used the indutive metodology and the bibliographic research.
