Civil Law in Constitutional legality, new challenges and other possibilities

Abstract

This paper briefly analyzes contemporary civil law, considering its hermeneutical possibilities from a constitutional perspective. Thus, it indicates possibilities for expanding and reimagining the concept of the human, individually and collectively, in the legal sphere, through a decolonial perspective and scaling repersonalization beyond anthropocentrism, including a stance of protecting nature and animals. It also defends the application of conventionality control, consisting of the domestic application of international conventions to which Brazil is a signatory.  Finally, it explores the possible perspectives for civil law as a result of the Protocol for Gendered Judgments.
