Principle of free alienation of rights in private law

Abstract

The aim of this study is to propose and determine the notion of "Principle of Free Alienation of Rights in Private Law” and point out the methodology for dealing with collisions with other principles. It distinguishes the concepts of rule and principle. It highlights the importance of the concept of topoi for understanding rules and principles as important milestones for legal discourse. It explores pratical situations that can be analyzed from the perspective on the Principle of Free Alienation of Rights: the prohibition of the predestination of the domain chain, the prohibition against the erosion of the real property rights, the seizure of homestead and the protection of cultural heritage.
