Competition law and the data portability

Abstract

The article seeks to demonstrate the importance of data portability as fulfillment of the fundamental right to data protection and its relationship with Competition Law, highlighting the relevance of data access in competition between digital platforms. Data protection as a legal framework that aims not only at the individual, but also at the protection of free initiative and competition for the offer of goods and services in the digital economy, through digital platforms that process and use personal data as an essential asset to achieve their social and market objectives. The research sought to demonstrate how the Administrative Council for Economic Defense has analyzed portability as a factor in possible abuses of dominant power and market concentration, acting to maintain the market in balance for better economic exploitation in the information society.

Doctor of Philosophy and General Theory of Law from the Faculty of Law of the University of São Paulo - USP, Visiting Researcher at the Max Planck Institute for Innovation and Competition - Munich (Post Doc), Master in Political and Economic Law and Bachelor of Laws from Mackenzie Presbyterian University. Regional Director for Brazil and Member of ASCOLA - Academic Society for Competition Law. President of the Legal Committee and member of the Board of Directors of the Italian Chamber of Commerce of São Paulo - ITALCAM. Researcher at the Observatory for the Application of Competition Law of the Catholic University of Portugal - Porto. President of the Commission of Studies on Competition and Economic Regulation of the OAB-SP (2013-2015). Vice President of the Brazilian Institute for Studies on Competition, Consumption and International Trade - IBRAC (2020-2021). Temporary consultant for the World Bank and the World Intellectual Property Organization. Non-governmental consultant for the International Competition Network - ICN, participated at the invitation of CADE in the Annual Conferences of the International Competition Network - ICN held respectively in Moscow, Zurich, Istanbul, The Hague, Rio de Janeiro, Warsaw, Marrakesh, Sydney, Singapore, Porto, New Delhi, Cartagena de Indias, Los Angeles (virtual) and Budapest (virtual), and the ICN Unilateral Conduct Workshops held in Brussels, Rome, and Stellenbosch and the ICN Advocacy Workshop held in Rome.
