Competition law and the data portability

Abstract

The article seeks to demonstrate the importance of data portability as fulfillment of the fundamental right to data protection and its relationship with Competition Law, highlighting the relevance of data access in competition between digital platforms. Data protection as a legal framework that aims not only at the individual, but also at the protection of free initiative and competition for the offer of goods and services in the digital economy, through digital platforms that process and use personal data as an essential asset to achieve their social and market objectives. The research sought to demonstrate how the Administrative Council for Economic Defense has analyzed portability as a factor in possible abuses of dominant power and market concentration, acting to maintain the market in balance for better economic exploitation in the information society.
