Travel agences civil liabity in the Superior Court of Justice case laws

Abstract

The research discusses the case laws signed by the Superior Court of Justice of breaking the chain of custody between travel agencies and airlines for unsatisfactory service in the event of buying and selling tickets without marketing travel packages. The objectives of the study are: to point out the foundations of case laws for breaking the chain of solidarity between tourism agencies and airlines in repairing damages borne by consumers and to analyze the nature of civil liability applied to the supply chain of tourist products and services. The work, essentially documental, involved a bibliographical, doctrinal and case laws survey. The results show the insufficient attention of the cases laws to the contractual bonds between tourism companies and suppliers, at the same time that the elision of joint and several liability disregards the expectation of protection of the consumer, who purchases products and services through these companies.
