Possession and property in the meta verse era

Abstract

Contrary to the provisions of 1916’s Brazilian Civil Code, the Brazilian Civil Code of 2002 ties possession and ownership to things (tangible assets).  However, this option is inappropriate not only on account of its inconsistency with the intellectual property legislation that preceded the advent of the current Code, but also because it does not cover digital assets, which means it is not able to protect property acquired virtually.  With the evolution of the metaverse, this study aims to evaluate the effects of purchases made on digital platforms, as well as the functions performed by possession and property in the face of this new reality.
