Abstract

This article seeks to explore the legal status of the so-called unassisted insemination, as well as the filiation that stems from it, the “planned affective filiation”. In an hermeneutic apprehension from Civil-Constitucional Law methodology, it seeks to reflect on this kind of filiation, which can be understood as resulting from heterologue insemination, whether laboratorial or unassisted, with legal provision based on the systematic interpretation of article 1,597, item V., of the Civil Code, in its relation to the exercise of planned parenthood and reproductive rights. Considering that the problem of filiation resulting from unassisted insemination often arises from its use by couples of women, it dialogues with the precedente set in ADI 4277/ADPF 132, regarding the equality of the same-sex family.
