Economic regulation, entrepreneurial contracts and the Economic Freedom Act

Abstract

The Economic Freedom Act changed provisions of private law that, in special in Contractual Law. By setting a more absentee stance by the State, it can lead to the conclusion that the mandatory standards should no longer be applied to private pacts. The deductive and historical method is used to address the interrelations between economic regulation and Contract Law, investigating the role of contracts in the regulation of the economy, the idea of contract crisis and the economic function of contracts. It is concluded that, in relation to private law, the LLE did not fulfill its objectives, not overruling out the application of more specific rules from regulated sectors, as well as they do not overrule out the application of mandatory standards of Contract Law, which have a constitutional basis.
