Attachment lien on debtor’s family assents on behalf of the guarantor in residential rental contracts

Abstract

According to the Brazilian Federal Supreme Court, the attachment lien on guarantor’s family assets in residential rental contracts is considered constitutional. This study does not have the purpose of confronting this understanding but aims to defend that the guarantor has the right to protect his personal assets, his dignity and his own economic interests. This is the reason why the guarantor should be allowed to claim attachment lien on debtor’s family assets using the subrogation established by law, because only by this legal instrument would the principles of prohibition of the debtor’s unjust enrichment, the social function of property, the good faith, which are Brazilian legal system guiding principles, will be respected.
