The Ryan Lochte Case and the Application of Moral Clause in Brazilian Contract Law System

Abstract

It became worldwide known the case of American swimmer Ryan Lochte that – during the 2016 Olympic Games - reported that had been victim of an armed robbery by policemen while was returning from a party in a nightclub located in Rio de Janeiro – fact subsequently disavowed by investigation. Because of his inadequate behavior, the medalist lost his main sponsors and was suspended by American Swimming Confederation. Considering this case, this study – in inductive method of approach – describes the moral clause and examines the possibility of its application to Brazilian contractual law, indicating its main consequences.
