Personality rights are presented as essential to the paradigm of the Democratic State of Right. Among them, the right to a name and the right to own body play an important function in creating the identity of human beings and their self-determination. In the theme of the transgender people, the guarantee to free exercise of the right to the name and the body becomes even more crucial. Incrisingly, the jurisprudence has acknowledged the possibility of change of the first name and sex in the civil registry of the transgender person after reassignment surgery. When there isn’t the surgery, however, the jurisprudence returns to not allow de changing. Considering that the gender category beyond the idea of biological sex, and taking into account the principle of human dignity, it is essential defense the possibility of changing in the civil registry, even without reassignment surgery, as a way to guarantee the dignity.
