From protagonism to marginalization: the succession of the affective partner in the proposed reform of the Civil Code (Bill 4/2025)

Abstract

This article examines the inheritance rights of spouses and partners in Brazilian civil law, focusing on Bill No. 4/2025. Using a historical and normative approach, grounded in legislation and case law, it aims to assess whether the repositioning of affective partners in the order of succession represents progress or setback in relation to constitutional and jurisprudential achievements. Based on the deductive method and critical bibliographic research, the study shows that the bill relegates the affective partner to a subsidiary position and excludes them from the category of necessary heirs, thereby weakening already recognized inheritance rights. Under the justification of private autonomy, the proposal reinforces historical inequalities and breaks with the principles of equality, human dignity, and the protection of plural families. It concludes that, in this respect, the reform constitutes a legal, social, and constitutional regression.
