Women's rights in the private sphere: menstrual dignity, protection against obstetric violence and delivery for adoption

Abstract

This article analyzes three themes of the highest relevance for Brazilian women and still little studied: menstrual dignity, obstetric violence and delivery for adoption. Themes relating to women's health and sexual and reproductive rights find space in international human rights conventions; however, they constitute a great absence in national legal standards and public policies. And, in the Civil Code and its new reform project, the proper scope for exercising this type of rights, this absence is even more felt. The work is based on the theory of justice of Paul Ricoeur (2001), whose paradox between autonomy and vulnerability resonates in the analysis of female issues. The methodology of "state of the art" and comparative law was also used.

Professora adjunta do Departamento de Direito Civil da Faculdade Nacional de Direito da Universidade Federal do Rio de Janeiro. Coordenadora do Programa de Pós-Graduação stricto sensu em Direito da Universidade Federal do Rio de Janeiro.
