Privacy and Hypernudges: challenges to autonomy

Abstract

This article examines the impacts of hypernudges on privacy and personal autonomy, aiming to understand how these digital suggestion techniques influence individuals' decisions and behaviors, often without explicit consent. The research explores the debate between libertarian paternalism and autonomy, highlighting the ethical and legal implications of the mass collection of data and its use to shape and manipulate choices. The methodology is based on a comprehensive literature review and a critical analysis of legislation and recent case law. It concludes that hypernudges pose a risk to decisional privacy, undermining self-determination, and emphasizes the need for more robust regulations to safeguard the dignity and autonomy of individuals in an increasingly invasive digital environment
