Data protection legislation and the post mortem protection of personal data: a comparative analysis between brazilian law and italian law

Abstract

In today's information society, personal data is protected under various legal systems. However, there are still controversies regarding its legal protection after the death of the data subject. In this context, through a legal-theoretical and comprehensive-comparative investigation between Brazilian and Italian legal systems, it was possible to conclude that the solution of the Italian law, whereby certain provisions of the GDPR apply to the data of deceased individuals until specific legislation is in place, is shown to be more appropriate. Thus, despite the ANPD's position in Technical Note N. 3/2023/CGF/ANPD, it is argued that data protection is a personality right and should receive post mortem protection, in line with the LGPD, until there is a specific legislation on the subject.
