Abstract

This article aims to analyze the institute of discharge, with specific focus on delimiting its scope when provided for in contractual instruments in a “broad, general, and irrevocable” manner, based on the decision rendered in the Appeal No. 1.993.187/MS, filed before the Third Panel of the Brazilian Superior Court of Justice. From a practical standpoint, the precise identification of the scope of discharge generates one of two possible effects: either hindering or authorizing the supplementation of payment even after the creditor has granted discharge.
